By downloading, accessing, or using the App, you agree to these Terms of Use and our Community Guidelines. You must be at least eighteen (18) years of age to register for or use the App. When you register, you will sign in using a one-time passcode delivered by SMS or by email, at your choice. You are responsible for maintaining the security of the device, phone number, and email account you use to receive passcodes, and for all activity that occurs under your account. Notify us promptly at app@cmagso.net of any unauthorized use of your account.
Subject to your compliance with these Terms of Use and our Community Guidelines, CMA grants you a limited, personal, non-exclusive, revocable, non-assignable, and non-transferable right and license to use the App in order to utilize the features contained within it.

The above licenses are conditional upon your strict compliance with these Terms of Use and our Community Guidelines at any and all times during your use of the App, including, without limitation, the following:
(i) You must not, and must not permit any third party to, copy or adapt the object code of the App, or reverse engineer, reverse assemble, decompile, modify or attempt to discover any source or object code of any part of the App, or circumvent or attempt to circumvent the App for any other purpose than its stated purpose.
(ii) You must not use the App to upload, post, store, transmit, display, copy, distribute, make available, continue to make available or otherwise communicate to other users:
- any content that is abusive, libelous, defamatory, pornographic or obscene, that promotes or incites violence, terrorism, illegal acts, or hatred on the grounds of race, ethnicity, cultural identity, religious belief, disability, gender, identity or sexual orientation, or is otherwise objectionable in CMA’s reasonable discretion;
- any material of any kind that contains any virus, Trojan horse, spyware, adware, malware, bot, time bomb, worm, or other harmful or malicious component, that may overburden, impair or disrupt the App or servers or networks forming part of, or connected to, the App, or which does or might restrict or inhibit any other user’s use and enjoyment of the App; or
- any unsolicited or unauthorized advertising, promotional messages, spam or any other form of solicitation.
(iii) You must not commit or engage in, or encourage, induce, solicit or promote, any conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law or regulation.
(iv) You must not deliberately impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity, for example, by registering an account in the name of another person, or sending messages or making comments using the name of another person.
(v) You must not stalk, exploit, threaten, abuse or otherwise harass another user.
(vi) You must not use or attempt to use another person’s account, password, or other information, unless you have express permission from that other person.
(vii) You must not collect or attempt to collect personal data, or any other kind of information about other users, including without limitation, through spidering or any form of scraping.
(viii) You must not violate, circumvent or attempt to violate or circumvent any data security measures employed by CMA. This includes any attempt to access data or materials which are not intended for your use; log into, or attempt to log into, a server or account which you are not authorized to access; attempt to scan or test the vulnerability of CMA’s servers, system or network or attempt to breach CMA’s data security or authentication procedures; attempt to interfere with the App or its supporting services by any means including, without limitation, hacking servers or systems, submitting a virus, overloading, mail-bombing or crashing. Without limitation to any other rights or remedies of CMA under these Terms of Use, CMA reserves the right to investigate any situation that appears to involve any of the above, and may report such matters to, and co-operate with, appropriate law enforcement authorities in prosecuting any users who have participated in any such violations.
You agree to comply with the above conditions at any and all times during your use of the App, and acknowledge and agree that CMA has the right, in its sole discretion, to terminate your account or take such other action as we see fit if you breach any of the above conditions or any of the other terms of these Terms of Use. This may include taking court action and/or reporting offending users to the relevant authorities.
Your Content
Text, photographs, images, comments, and other content that you upload, store, transmit, or make available through the App (“Your Content”) remains owned by you or the applicable rights holder. CMA does not claim ownership of Your Content. You are responsible for ensuring that you have the rights necessary to share Your Content through the App. By uploading, storing, transmitting, or making available Your Content through the App, you grant CMA a non-exclusive, revocable license to use Your Content solely for the purpose of providing and operating the App’s functionality.
The App includes a Circles feature through which users may share posts, comments, images, and other content with other users. Users are automatically enrolled in CMA’s default Circle for general announcements and updates and may leave that Circle. Content shared within a Circle is intended to be visible to its authorized members. Users should exercise care when sharing personal or recovery-related information, as CMA cannot control whether other users retain, copy, or disclose information they receive.
Representations and Warranties
You hereby represent and warrant to CMA as follows:
(i) Your Content, and each and every part thereof, is an original work by you, or you have obtained all rights, licenses, consents and permissions necessary in order to use at any and all times during any applicable use.
(ii) Your Content and the availability thereof on the App does not and will not infringe or violate the rights of any third party, including, without limitation, any intellectual property rights, rights of privacy or publicity, or rights in confidential information.
(iii) Your Content, including any comments that you may post on the App, is not and will not be unlawful, abusive, libelous, defamatory, pornographic or obscene, and will not promote or incite violence, terrorism, illegal acts, or hatred on the grounds of race, ethnicity, cultural identity, religious belief, disability, gender, identity or sexual orientation.
(iv) Your Content does not and will not create any liability on the part of CMA, its volunteers, directors, and officers. CMA reserves the right to remove Your Content, suspend or terminate your access to the App and/or pursue all legal remedies if we believe that any of Your Content breaches any of the foregoing representations or warranties, or otherwise infringes another person’s rights or violates any law, rule or regulation.
Liability for Content
CMA provides functionality through which users may upload, store, and share content. Users are responsible for the content they submit or share through the App. CMA does not review or approve all user-generated content before publication but may review, restrict, or remove content, respond to user reports, and take other appropriate action in accordance with these Terms of Use, the Community Guidelines, and applicable law. To the extent permitted by applicable law, CMA is not responsible for content created or shared by other users or for the accuracy, completeness, or reliability of user-generated content.
Reporting Content or Conduct
If you encounter content or conduct that you believe violates these Terms of Use, the Community Guidelines, or your rights, you may report it using any reporting feature available within the App or by contacting CMA at app@cmagso.net.
Blocking and Removal of Content
CMA reserves the right to review, restrict, remove, or delete content, and to limit or suspend access to content or accounts when CMA reasonably believes that the content or conduct violates these Terms of Use, the Community Guidelines, applicable law, or the rights of another person. CMA may take such action without prior notice where appropriate, subject to applicable law.
Please also note that individual users have control over the content that they store in their respective accounts, and may remove any or all content without notice. You have no right of continued access to any particular item of content and CMA shall have no liability in the event that you are unable to access an item of content due to its removal from the App, whether by CMA or the relevant user, to the extent permitted by applicable law.
Repeat Infringers
CMA may issue warnings, remove content, restrict access, suspend accounts, or terminate accounts if CMA determines that a user has violated these Terms of Use or the Community Guidelines. CMA may take action without prior warning when warranted by the nature or seriousness of the violation. Reports of violations may be reviewed by CMA’s designated administrators, who may determine the appropriate response based on the circumstances. Refund requests relating to subscriptions purchased through the Apple App Store or Google Play are subject to the applicable app store’s procedures and applicable law.
Disclaimer
THE CMA APP IS PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS”.
CMA MAKES NO PROMISES, GUARANTEES, REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER (EXPRESS OR IMPLIED) REGARDING THE APP, THE SERVICES OR ANY PART OR PARTS THEREOF, ANY CONTENT, OR ANY LINKED SERVICES OR OTHER EXTERNAL SERVICES. CMA DOES NOT WARRANT THAT YOUR USE OF THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR ANY PART OR PARTS THEREOF, THE CONTENT, OR THE SERVERS ON WHICH THE APP OPERATES ARE OR WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CMA DOES NOT WARRANT THAT ANY TRANSMISSION OF CONTENT UPLOADED TO THE APP WILL BE SECURE OR THAT ANY ELEMENTS OF THE APP DESIGNED TO PREVENT UNAUTHORIZED ACCESS, SHARING OR DOWNLOAD OF CONTENT WILL BE EFFECTIVE IN ANY AND ALL CASES, AND DOES NOT WARRANT THAT YOUR USE OF THE APP IS LAWFUL IN ANY PARTICULAR JURISDICTION.
CMA AND ITS VOLUNTEERS, CONTRACTORS, DIRECTORS, AND OFFICERS, SPECIFICALLY DISCLAIM ALL OF THE FOREGOING WARRANTIES AND ANY OTHER WARRANTIES NOT EXPRESSLY SET OUT HEREIN TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING WITHOUT LIMITATION ANY EXPRESS OR IMPLIED WARRANTIES REGARDING NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.
WHERE THE LAW OF ANY JURISDICTION LIMITS OR PROHIBITS THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES AS SET OUT ABOVE, THE ABOVE DISCLAIMERS SHALL NOT APPLY TO THE EXTENT THAT THE LAW OF SUCH JURISDICTION APPLIES TO THIS AGREEMENT. IF YOU ARE A CONSUMER IN THE UNITED KINGDOM OR THE EUROPEAN UNION, NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS, INCLUDING ANY RIGHT TO DIGITAL CONTENT THAT IS AS DESCRIBED, FIT FOR PURPOSE, AND OF SATISFACTORY QUALITY.
Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, CMA’S AGGREGATE LIABILITY TO YOU ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100) OR THE AMOUNTS PAID BY YOU FOR SERVICES THROUGH THE APP DURING THE PREVIOUS TWELVE (12) MONTHS GIVING RISE TO THE CLAIM.
CMA AND ITS VOLUNTEERS, CONTRACTORS, DIRECTORS, AND OFFICERS SHALL HAVE NO LIABILITY FOR:
1. ANY LOSS OR DAMAGE ARISING FROM: (A) YOUR INABILITY TO ACCESS OR USE THE APP OR ANY PART OR PARTS THEREOF, OR TO ACCESS ANY CONTENT OR ANY EXTERNAL SERVICES VIA THE APP; (B) ANY CHANGES THAT CMA MAY MAKE TO THE APP OR ANY PART THEREOF, OR ANY TEMPORARY OR PERMANENT SUSPENSION OR CESSATION OF ACCESS TO THE APP OR ANY CONTENT IN OR FROM ANY OR ALL TERRITORIES; (C) ANY ERRORS OR OMISSIONS IN THE APP’S TECHNICAL OPERATION, OR FROM ANY INACCURACY OR DEFECT IN ANY CONTENT OR ANY INFORMATION RELATING TO CONTENT; (D) YOUR FAILURE TO PROVIDE CMA WITH ACCURATE OR COMPLETE INFORMATION, OR YOUR FAILURE TO KEEP YOUR SIGN-IN CREDENTIALS (INCLUDING THE DEVICE, PHONE NUMBER, OR EMAIL ACCOUNT USED TO RECEIVE ONE-TIME PASSCODES) SUITABLY CONFIDENTIAL AND SECURE; (E) ANY MISCONDUCT BY OTHER USERS OR THIRD PARTIES USING THE APP, ESPECIALLY IN BREACH OF THE AGREEMENT; AND
2. ANY LOSS OR DAMAGE TO ANY COMPUTER HARDWARE OR SOFTWARE, ANY LOSS OF DATA (INCLUDING YOUR CONTENT).
APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH CASES, YOU ACKNOWLEDGE AND AGREE THAT SUCH LIMITATIONS AND EXCLUSIONS REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND CMA AND ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND CMA, AND THAT CMA’S LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
NOTHING IN THESE TERMS OF USE LIMITS OR EXCLUDES THE LIABILITY OF CMA, ITS VOLUNTEERS, CONTRACTORS, DIRECTORS, OR OFFICERS: (I) FOR ANY DEATH OR PERSONAL INJURY CAUSED BY ITS OR THEIR NEGLIGENCE, (II) FOR ANY FORM OF FRAUD OR DECEIT, (III) FOR ANY DAMAGES CAUSED WILLFULLY OR BY GROSS NEGLIGENCE, OR (IV) FOR ANY FORM OF LIABILITY WHICH CANNOT BE LIMITED OR EXCLUDED BY LAW.
Indemnification
You hereby agree to indemnify, defend and hold harmless CMA, its volunteers, contractors, directors, and officers, from and against any and all claims, obligations, damages, losses, expenses, and costs, including reasonable attorneys’ fees, resulting from:
(i) any violation by you of these Terms of Use or our Community Guidelines.
(ii) any third party claim of infringement of copyright or other intellectual property rights or invasion of privacy arising from your content on the App, and/or your making available thereof to other users of the App, and/or the actual use of Your Content by other users of the App in accordance with these Terms of Use and the parameters set by you with respect to the distribution and sharing of Your Content;
(iii) activity conducted through your account to the extent resulting from your breach of these Terms of Use or your intentional or negligent conduct. If you are a consumer in the UK or the EU, this indemnity applies only to losses caused by your breach of these Terms of Use or applicable law.
Data Protection and Privacy
All personal data that you provide to us in connection with your use of the App is collected, stored, used, disclosed and otherwise processed by CMA in accordance with our Privacy Policy.
Changes to the App, Accounts, and Pricing
CMA may modify, suspend, discontinue, or change features of the App from time to time, including the availability of particular services or subscription options. Where reasonably practicable, CMA will provide advance notice of material changes affecting users, subject to any additional notice requirements under applicable law.
Changes affecting paid subscriptions, including pricing and renewals, will be handled in accordance with applicable Apple App Store or Google Play procedures and applicable law. CMA may communicate general App updates and announcements through the App, including the default CMA Circle, or through other available communication methods. Notices required by applicable law will be provided through an appropriate method.
Subscriptions and Billing
The App offers optional paid subscriptions, including annual subscription plans, purchased through the Apple App Store or Google Play. The applicable purchase screen identifies the subscription price, billing period, renewal terms, and other applicable conditions. Subscriptions may renew automatically as described in the applicable purchase terms unless canceled through the relevant app store. Subscription payments, renewals, cancellations, and refunds are administered through Apple or Google, subject to applicable law. Deleting the App or your CMA account does not automatically cancel an active subscription.
Consumer Cancellation Rights (EU and UK)
If you are a consumer in the European Union or United Kingdom, you may have statutory rights to cancel or withdraw from a subscription purchase, subject to applicable law and any relevant exceptions. Nothing in these Terms limits those rights. Subscription cancellations and refund requests ordinarily are administered through the Apple App Store or Google Play, as applicable. For questions about your statutory rights or assistance with a request, you may contact CMA at app@cmagso.net.
Apple App Store and Google Play Terms
If you download the App from the Apple App Store, the following applies: these Terms of Use are between you and CMA only, not with Apple Inc. (“Apple”), and Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or similar claims. In the event of a third-party claim that the App infringes intellectual property rights, CMA, not Apple, is responsible for the investigation, defense, settlement and discharge of such claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Your use of the App must comply with the Apple Media Services Terms and Conditions, including the Usage Rules. Apple and its subsidiaries are third-party beneficiaries of these Terms of Use and may enforce them against you. If you download the App from Google Play, your use of the App must also comply with the Google Play Terms of Service.
Termination
You may terminate this Agreement by providing written notice to CMA at CMA General Services, 1920 Hillhurst Ave #1315, Los Angeles, CA 90027, or by initiating deletion of your account through the Delete Account option in the App’s profile menu and ceasing to use the App. CMA may suspend or terminate your access to the App if you violate these Terms of Use or the Community Guidelines, if required by law, if CMA discontinues the App or services in an applicable jurisdiction, or for other reasonable grounds consistent with these Terms and applicable law.
Following termination, you may no longer have access to your account or associated content. CMA’s current account-deletion process removes the user’s sign-in account, but certain associated records may remain in CMA’s systems, as described in the Privacy Policy. Users may contact CMA at app@cmagso.net regarding requests to delete additional personal information, subject to applicable law and legitimate retention requirements. You should retain copies of any content you wish to keep before terminating your account. Terminating your CMA account does not automatically cancel an active subscription. Subscriptions must be canceled through the applicable Apple or Google account. Refund requests are subject to the applicable app store’s procedures and applicable law.
Provisions that by their nature are intended to survive termination will remain effective, including, as applicable, those concerning user content, disclaimers, limitations of liability, indemnification, and dispute resolution.
Severability
Should one or more provisions of these Terms of Use be found to be unlawful, void or unenforceable, such provision(s) shall be deemed severable and will not affect the validity and/or enforceability of the remaining provisions of the Terms of Use, which will remain in full force and effect.
Entire Agreement
These Terms of Use, together with the Community Guidelines, constitute the entire agreement between you and CMA with respect to your use of the App (other than any use of CMA’s APIs which may also be subject to separate API Terms of Use), and supersede any prior agreement between you and CMA. Any modifications to this Agreement must be made in writing.
Applicable Law and Jurisdiction
Except where otherwise required by the mandatory law of the United States, the United Kingdom, or any member state of the European Union: (i) this Agreement is subject to the laws of the State of California, without regard to its conflict-of-laws rules; and (ii) you hereby agree, and CMA agrees, to submit to the exclusive jurisdiction of the courts in Los Angeles, California for resolution of any dispute, action or proceeding arising in connection with this Agreement.
If you are a consumer habitually resident in the UK or in a member state of the EU, you additionally benefit from any mandatory provisions of the law of the country in which you reside, and nothing in this Agreement affects your rights as a consumer to rely on such mandatory provisions of local law. You may bring proceedings arising out of this Agreement in the courts of the country in which you reside, and proceedings against you may be brought only in those courts.
